The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Los pueblos originarios que habitaban —y habitan— el territorio actualmente ocupado por el Estado argentino han sido objeto de una serie de procesos simultáneos de desposesión, discriminación y pauperización. No obstante, con el paso de las décadas y en el marco de la lucha que los primeros llevaran a cabo, el gobierno ha adecuado parte de su legislación a los requerimientos internacionales en relación con el respeto debido hacia los derechos de todos los pueblos. En ese marco, la ciudad rionegrina (...) de San Carlos de Bariloche —principal núcleo urbano del territorio provincial— fue declarada formalmente como Municipio intercultural en 2015. Sin embargo, a pesar del pronunciamiento oficial y del compromiso exigible a los dirigentes locales, algunas situaciones dan cuenta de una aplicación superflua y acotada de la normativa, así como, también, de la pervivencia de una historiografía conservadora que incide con efectos reaccionarios en el accionar de los funcionarios. Puntualmente, en base al análisis de circunstancias específicas bajo el marco intercultural de la legislación local vigente, el presente artículo se propone precisar falencias en el accionar del Municipio para dar cuenta de una postura vaga respecto del acompañamiento y salvaguarda de las comunidades mapuche. De esta manera, sin pretender que lo intercultural se agota en la relación pueblos originarios/Estado, el objetivo es encender una luz de alerta que motive un accionar superador por parte de quienes ejercen —y ejerzan— la función pública en la ciudad, bajo la convicción de que es necesario reivindicar los derechos del pueblo mapuche a su propia historia, territorio e identidad, todos ellos derechos humanos garantizados por la legislación internacional para todos los habitantes del planeta. This article studies natural food packaging as enabling artifacts of the traditional material culture of Antioquia in Colombia. For this purpose, we consider artifacts as objective nodes that combine design and use intentions, functions, materials, histories, artifactual lineages, and cooperative relationships that stabilize ritualized practices of a human group. We take the example of natural packaging as artifacts that enablers and stabilizers of traditional cooking and food preparation practices. Natural packaging materials are here assumed to be leaves having some favorable (...) property to contain a food product. After providing a theoretical reflection, we analyze the data collected from fieldwork we conducted in two towns in Antioquia, Colombia (Santa Fe de Antioquia and Amagá), as well as from an interview with an expert in the field. Finally, we show that it is possible to postulate an analysis under a relational ontological description of a traditional practice with conceptual categories of the philosophy of technology. Ernesto Laclau es un reconocido teórico político precursor del postmarxismo. Si bien reside en Inglaterra hace varios lustros, su vinculación con Argentina y América Latina sigue siendo muy importante. Su libro Hegemony and Socialist Strategy de 1985 (aparecido en español en 1987 con el título Hegemonía y Estrategia Socialista) co-escrito con Chantal Mouffe tuvo un gran impacto en el pensamiento de la intelectualidad de izquierda identificada con un proyecto de radicalización de los ideales ..

Esta reflexión hunde sus raíces en las obras transicionales de Ernesto Sabato: Uno y el Universo y Hombres y engranajes, con elementos muy propios del mundo que instaura El túnel. Allí Juan Pablo Castel, encarna el túnel de su propia existencia desde dos puntos equidistantes y superpuestos: primero, la inmersión, que realiza como artista cuando pinta -una posibilidad que desafía toda lógica-, y segundo, la explicación, planteada como la necesidad de clarear una mujer inquieta y solitaria, frente a (...) un mar tormentoso. Lo que permitirá comprender cómo Juan Pablo Castel caminará en dos direcciones necesarias, que no admitirán una síntesis: primero, la dirección yo-universo, que encaja en la necesidad de gobernar el mundo a partir de la abstracción, la urgencia de explicación de ese hombre profano que despierta de un sueño profundo; segundo, la dirección universo-uno en tanto búsqueda de lo humano, sin disminuir las contradicciones, ese largo ir y venir que no agota esas dos tendencias entremezcladas y ambivalentes. Este trabajo tiene la finalidad de fundamentar las razones que conducen al personaje Juan Pablo Castel de la novela de Ernesto Sabato El túnel (1948) a la psicosis, entendida esta como una estrategia involuntaria para interpretar la realidad y actuar en función de la cosmovisión que le genera. Para explicar esa adopción identitaria, retomo la taxonomía elaborada por Donald Shaw con respecto al contexto influyente del boom latinoamericano (que repercute negativamente en la psicología social) y la epistemología psicoanalítica (...) de Jacques Lacan al hacer referencia a nociones afines que configuran al protagonista como una entidad desligada del mundo real y que cuenta con un potencial saber infundado hacia la destrucción del ser. This paper presents and defends a way to add a transparent truth predicate to classical logic, such that and A are everywhere intersubstitutable, where all T-biconditionals hold, and where truth can be made compositional. A key feature of our framework, called STTT (for Strict-Tolerant Transparent Truth), is that it supports a non-transitive relation of consequence. At the same time, it can be seen that the only failures of transitivity STTT allows for arise in paradoxical cases.

This essay explores the relation between two perspectives on the nature of human rights. According to the "political" or "practical" perspective, human rights are claims that individuals have against certain institutional structures, in particular modern states, in virtue of interests they have in contexts that include them. According to the more traditional "humanist" or "naturalistic" perspective, human rights are pre-institutional claims that individuals have against all other individuals in virtue of interests characteristic of their common humanity. This essay argues that (...) once we identify the two perspectives in their best light, we can see that they are complementary and that in fact we need both to make good normative sense of the contemporary practice of human rights. It explains how humanist and political considerations can and should work in tandem to account for the concept, content, and justification of human rights. (shrink)

This paper explores the connections between human rights, human dignity, and power. The idea of human dignity is omnipresent in human rights discourse, but its meaning and point is not always clear. It is standardly used in two ways, to refer to a normative status of persons that makes their treatment in terms of human rights a proper response, and a social condition of persons in which their human rights are fulfilled. This paper pursues three tasks. First, it provides an (...) analysis of the content and an interpretation of the role of the idea of human dignity in current human rights discourse. The interpretation includes a pluralist view of human interests and dignity that avoids a narrow focus on rational agency. Second, this paper characterizes the two aspects of human dignity in terms of capabilities. Certain general human capabilities are among the facts that ground status-dignity, and the presence of certain more specific capabilities constitutes condition-dignity. Finally, this paper explores how the pursuit of human rights and human dignity links to distributions and uses of power. Since capabilities are a form of power, and human rights are in part aimed at respecting and promoting capabilities, human rights involve empowerment. Exploring the connections between human rights, capabilities, and empowerment provides resources to defend controversial human rights such as the right to democratic political participation, and to respond to worries about the feasibility of their fulfillment. This paper also argues that empowerment must be coupled with solidaristic concern in order to respond to unavoidable facts of social dependency and vulnerability. (shrink)

To be justifiable, the demands of a conception of human rights and global justice must be such that (a) they focus on the protection of important human interests, and (b) their fulfilment is feasible. I discuss the feasibility condition. I present a general account of the relation between moral desirability, feasibility and obligation within a conception of justice. I analyse feasibility, a complex idea including different types, domains and degrees. It is possible to respond in various ways if the fulfilment (...) of basic socioeconomic human rights against severe poverty seems at first to be infeasible. (shrink)

In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. According to a popular narrative, in 1932 von Neumann introduced a theorem that intended to be a proof of the impossibility of hidden variables in quantum mechanics. However, the narrative goes, Bell later spotted a flaw that allegedly shows its irrelevance. Bell’s widely accepted criticism has been challenged by Bub and Dieks: they claim that the proof shows that viable hidden variables theories cannot be theories in Hilbert space. Bub’s and Dieks’ reassessment has been in turn challenged by Mermin and (...) Schack. Hereby I critically assess their reply, with the aim of bringing further clarification concerning the meaning, scope and relevance of von Neumann’s theorem. I show that despite Mermin and Schack’s response, Bub’s and Dieks’ reassessment is quite correct, and that this reading gets strongly reinforced when we carefully consider the connection between von Neumann’s proof and Gleason’s theorem. This paper aims to offer an account of affective experiences within Predictive Processing, a novel framework that considers the brain to be a dynamical, hierarchical, Bayesian hypothesis-testing mechanism. We begin by outlining a set of common features of affective experiences that a PP-theory should aim to explain: feelings are conscious, they have valence, they motivate behaviour, and they are intentional states with particular and formal objects. We then review existing theories of affective experiences within Predictive Processing and delineate two families (...) of theories: Interoceptive Inference Theories and Error Dynamics Theories. We highlight the strengths and shortcomings of each family of theories and develop a synthesis: the Affective Inference Theory. Affective Inference Theory claims that valence corresponds to the expected rate of prediction error reduction. In turn, the particular object of a feeling is the object predicted to be the most likely cause of expected changes in prediction error rate, and the formal object of a feeling is a predictive model of the expected changes in prediction error rate caused by a given particular object. Finally, our theory shows how affective experiences bias action selection, directing the organism towards allostasis and towards optimal levels of uncertainty in order to minimise prediction error over time. When we speak about different interpretations of quantum mechanics it is suggested that there is one single quantum theory that can be interpreted in different ways. However, after an explicit characterization of what it is to interpret quantum mechanics, the right diagnosis is that we have a case of predictively equivalent rival theories. I extract some lessons regarding the resulting underdetermination of theory choice. Issues about theoretical identity, theoretical and methodological pluralism, and the prospects for a realist stance towards quantum (...) theory can be properly addressed once we recognize that interpretations of quantum mechanics are rival theories. Business Ethics: A European Review, EarlyView.

In 1991 Larry Laudan and Jarret Leplin proposed a solution for the problem of empirical equivalence and the empirical underdetermination that is often thought to result from it. In this paper we argue that, even though Laudan and Leplin’s reasoning is essentially correct, their solution should be accurately assessed in order to appreciate its nature and scope. Indeed, Laudan and Leplin’s analysis does not succeed in completely removing the problem or, as they put it, in refuting the thesis of underdetermination (...) as a consequence of empirical equivalence. Instead, what they show is merely that science possesses tools that may eventually lead out of an underdetermination impasse. We apply their argument to a real case of two empirically equivalent theories: Lorentz’s ether theory and Einstein’s special relativity. This example illustrates the validity of Laudan and Leplin’s reasoning, but also shows the importance of the reassessment we argue for. (shrink)

Engaging Polanyi’s embeddedness–disembeddedness framework, this study explored the work experiences of Bhil children employed in Indian Bt cottonseed GPNs. The innovative visual technique of drawings followed by interviews was used. Migrant children, working under debt bondage, underwent greater exploitation and perennial and severe depersonalized bullying, indicative of commodification of labour and disembeddedness. In contrast, children working in their home villages were not under debt bondage and underwent less exploitation and occasional and mild depersonalized bullying, indicative of how civil society organizations, (...) along with the state, attempt to re-embed economic activities in the social context. Polanyi’s double movement was evident. ‘Place’ emerged as the pivotal factor determining children’s experiences. A ‘protective alliance’ of community controls and social power, associated with in-group affiliations and cohesive ties, stemming from a common village and tribal identity, aided children working at home for Bhil farmers. ‘Asymmetric intergroup inequality’ due to pronounced social identity and class differences, coupled with locational constraints and developmental disadvantage, made migrant children vulnerable targets. Social embeddedness influences how child workers are treated because it forces employers to be ethical and not engage in bullying. However, by shifting production to children’s home villages, there is an attempt to obscure the difference between child labour and child work. Thus, the seeds of disembeddedness are sown through the very act of re-embeddeding, potentially hampering future interventions. (shrink)

Some authors have suggested that the All Affected Interests Principle, an influential principle of political inclusion, requires that animals have their interests politically represented. In this paper, I provide a systematic formulation, assessment, and defense of this argument, and suggest a middle way between two strategies found in the literature. On the one hand, I argue that applying the All Affected Interests to animals inevitably requires that we make some (potentially controversial) assumptions about the weight and scope of animal interests, (...) and cannot remain morally noncommittal. This is because most formulations of the principle do not apply to all interests, but only to those that satisfy a relevancy test – which requires first-order moral reasoning. On the other hand, I also contend that one can defend some substantive claims about the inclusion of animals via the All Affected Interests Principle without having to endorse a comprehensive account of animal rights, or a theory about the worth of natural entities. For the All Affected Interests Principle to apply to animals, all that we need are instances of normatively relevant interests systematically affected by political decisions. The interest of mammals in avoiding pain and suffering, I contend, provides such an example. (shrink)

Alongside scholarly and societal dimensions of research impact, the meaningfulness of research, emerging from the link to context, is crucial. Authentic inclusion of Global South scholars based in the Global South aids these objectives.

It is a widespread belief that the Kochen-Specker theorem imposes a contextuality constraint on the ontology of beables in quantum hidden variables theories. On the other hand, after Bell’s influential critique, the importance of von Neumann’s wrongly called ‘impossibility proof’ has been severely questioned. However, Max Jammer, Jeffrey Bub and Dennis Dieks have proposed insightful reassessments of von Neumann’s theorem: what it really shows is that hidden variables theories cannot represent their beables by means of Hermitian operators in Hilbert space. Hereby I show that i) the very same constraint can be derived from Gleason’s theorem, and that ii) if we consider the import of von Neumann’s and Gleason’s theorems, the relevance of the Kochen-Specker theorem for hidden variables theories gets substantially weakened: it does not force them to be contextual in any interesting sense of the term. I will examine the first of Thomas Kuhn’s Thalheimer Lectures delivered in 1984, with the purpose of establishing a connection between Kuhn’s historiographical thought and his criticism of the traditional distinction between the context of discovery and the context of justification, or, as I call it, the DJ distinction. In order to do this, I will start by exploring the Kuhnian view of the so-called static approach in philosophy of science, taking as my main reference the work of Bacon, Descartes, (...) and foundationalist epistemology. I will continue by examining the relationship between Kuhnian historiography and the DJ distinction, comparing the first Thalheimer Lecture with other texts published by Kuhn. Finally, I will assert that Kuhn’s rejection of the DJ distinction is the result of adopting a historiographical matrix whose philosophical consequences are irreconcilable with the static approach in history and philosophy of science, for which the DJ distinction is essential. In this paper, I discuss the problem of scientific laws in general and laws of biology in particular. After reviewing the debate around the existence of laws in biology, I examine the subject in the light of the structuralist notion of a fundamental law and argue for the law of matching as the fundamental law of genetics.

This article presents a reconstruction of the so-called classical, formal or Mendelian genetics, which is intended to be more complete and adequate than existing reconstructions. This reconstruction has been carried out with the instruments, duly modified and extended with respect to the case under consideration, of the structuralist conception of theories. The so-called Mendel’s Laws, as well as linkage genetics and gene mapping are formulated in a precise manner while the global structure of genetics is represented as a theory-net. Is democracy a human right? There is a growing consensus within international legal and political practice that the answer is “Yes.” However, some philosophers doubt that we should see democracy as a human right. In this paper I respond to the most systematic challenge presented so far, which was recently offered by Joshua Cohen. His challenge is directed to the view that democracy is a human right, not to the view that democracy is part of what justice demands. It is (...) instructive because it forces us to consider important questions about the nature and justification of human rights, including the putative human right to democracy. There is a tendency to see every claim of justice as a human right, and Cohen presses us to face the risk that this slip may occur in the case of democracy. Thus my aim is not simply to refute Cohen’s arguments but to engage the questions he forcefully and helpfully puts on the table. I start in section 2 by analyzing Cohen’s account of human rights. In section 3 I defend the human right to democracy against his challenge. I conclude in section 4 by articulating some reasons for the claim that democracy is a human right that mobilize and elaborate on some of Cohen’s own key premises. (shrink)

En esta trabajo se analiza la relación existente entre las propuestas de Mendel, de los "redescubridores" -de Vries, Correns y Tschermak-, de Bateson y colaboradores y de Morgan y discípulos, e.e. la historia de la genética "clásica", en términos de "inconmensurabilidad", de forma tal de capturar y precisar tanto la idea de que entre éstas se dan ciertas discontinuidades y rupturas como de que éstas tienen "algo" que ver de algún modo entre sí. En particular, se introducen, con ayuda del (...) marco conceptual de la metateoría estructuralista, y aplican al presente caso, los conceptos de "inconmensurabilidad teórica" y "comparabilidad empírica". In this paper the existing relationship between the proposals of Mendel, the "rediscoverers" -de Vries, Correns and Tschermak-, Bateson and collaborators and Morgan and disciples, e.g. the history of "classical" genetics is analyzed in terms of "incommensurability", in such a way to capture and to precise so much the idea that among them take place some discontinuities and ruptures as well as that they have "something" to do with each other. In particular, the concepts of "theoretical incommensurability" and "empirical comparability" are introduced with the help of the conceptual framework of the structuralist view of theories and applied to this case. Three ethics program components, a code of ethics, ethics training initiatives and ethics-oriented performance appraisal content, were examined for their relationship to ethical intent using a sample of 525 employees from the Spanish financial services industry. As expected, all three components contributed to the prediction of ethical intent. Importantly, clusters of employees who reported experiencing distinct combinations of the program components were identified and compared for their level of ethical intent. Employees who perceived all three components to be strongly implemented (...) reported significantly higher levels of ethical intent relative to those who viewed the components as either all weakly implemented or not present. Combinations including training initiatives plus one other element had a similar impact to the fully implemented approach. Contrary to expectations, ethics-oriented performance appraisal content did not relate more strongly to ethical intent than codes of ethics. (shrink)

Burnout is characterized by emotional exhaustion and caused by exposure to excessive and prolonged stress related to job conditions. Moreover, burnout is highly prevalent among health care professionals. The aim of this study is, first, to examine the mediating role of social support over the effect of burnout in health care professionals and, second, to explore potential gender differences. A convenience sample of 1,035 health professionals from Ecuador, including 608 physicians and 427 nurses, was surveyed using the Maslach Burnout Inventory, (...) Social Support Survey, and General Health Questionnaire as measures of burnout, social support, and general health, respectively. Social support was found to mediate the negative effects of burnout on health regardless of gender. Differences across the three dimensions of burnout and health are further discussed, along with their implications for designing effective burnout interventions for health care professionals in Ecuador. Deontic logic is devoted to the study of logical properties of normative predicates such as permission, obligation and prohibition. Since it is usual to apply these predicates to actions, many deontic logicians have proposed formalisms where actions and action combinators are present. Some standard action combinators are action conjunction, choice between actions and not doing a given action. These combinators resemble boolean operators, and therefore the theory of boolean algebra offers a well-known athematical framework to study the properties of the (...) classic deontic operators when applied to actions. In his seminal work, Segerberg uses constructions coming from boolean algebras to formalize the usual deontic notions. Segerberg’s work provided the initial step to understand logical properties of deontic operators when they are applied to actions. In the last years, other authors have proposed related logics. In this chapter we introduce Segerberg’s work, study related formalisms and investigate further challenges in this area. (shrink)

The aim of this paper is to propose a model for understanding the relation between substance and procedure in discourse ethics and deliberative democracy capable of answering the common charge that they involve an ‘empty formalism’. The expressive-elaboration model introduced here answers this concern by arguing that the deliberative practical rationality presupposed by discourse ethics and deliberative democracy involves the creation of a practical medium in which certain general basic ideas of solidarity, equality and freedom are expressed and elaborated in (...) the context of widespread moral disagreement. In the course of this paper I propose an elucidation of these ideas and argue for the thesis that they are internally related to the endorsement of deliberative practical rationality. The three basic substantive ideas contribute to the determination of the existence, the form, the topics and intended outcomes, and the effects of the practice of public deliberation. This amounts to an elucidatory defense of deliberative practical rationality by explicating its substantive significance or point. After discussing the transformation of age-old agricultural practices that has been occurring since the mid nineteenth century, and its impact on the natural environment, I identify four features of technology that point to the ambiguity of the idea of "technological progress". These are linked to the intrinsic unpredictability of technological applications and have implications for evaluating technological risks. I then show that large scale technological applications and innovations - such as expanding the practice of smallpox inoculation in the second half (...) of the eighteenth century - occur in states of 'technological exception'. In them, values are suspended and rules, limits and security norms are absent; and, in the face of risks, losses and harm to health and environment that are occasioned by technological applications introduced in the name of economical progress , normal social inhibitions become suspended in the name of furthering the values of capital and market. In addition, I show that maintaining technological exception has favored, on the one hand, the development by large corporations of antiscientific practices that threaten the moral integrity of science by impeding the proper use of the scientific method for evaluating the consequences of using technologies that are protected by patents; and, on the other hand, under the cover of ignorance, continued deterioration of the environment that threatens the very survival of the human species. Whenever a fact P grounds another fact Q, one may ask why that is so. Karen Bennett and Louis deRosset independently argue that grounding facts—such as the fact that P grounds Q—are always grounded in their grounds-part. Bennett calls this the view that grounding is superinternal. My aim in this paper is to argue that grounding is not superinternal. I will do so by showing that superinternality, together with some widely accepted formal features of grounding—namely, transitivity and necessitation—yield implausible claims (...) about how necessities are explained. Then, I will discuss how my argument compares with Dasgupta's argument against superinternality. (shrink)

Taking as starting point Kuhn’s analysis of science textbooks and its application to Sinnott and Dunn’s (1925), it will be discussed the problem of the existence of laws in biology. In particular, it will be showed, in accordance with the proposals of Darden (1991) and Schaffner (1980, 1986, 1993), the relevance of the exemplars, diagrammatically or graphically represented, in the way in which is carried out the teaching and learning process of classical genetics, inasmuch as the information contained in them, (...) indispensable for the right development of that process, exceeds the information contained in the “laws” linguistically articulated and presented in the textbooks. However, it will be maintained that the information is implicit in the law that according to the structuralist concept of fundamental law and the reconstruction of genetics presented by Balzer & Dawe (1990), and later developed by Balzer & Lorenzano (1997) and Lorenzano (1995, 2000, 2002a) could be considered the fundamental law of classical genetics,the law of matching, clearly identified in this paper. The problem of alterity can be posed in two areas: a) that of absolute alterity, which Descartes develops in the Third Meditation when the ego discovers himself as a negation of infinite and an aspiration to the infinite; b) that of relative alterity that distinguishes me from my fellow man. Firstly, we risk a synthesis of the ways in which the alter ego loses his otherness when conceived as an object of representation or desire. Secondly, we propose that Descartes thinks (...) of alterity in a purely ethical sense, as a capacity for good and evil. Our thesis is, first: pure love (without desire) is parental love —the only one addressed to others themselves for themselves, the only one that opens the possibility of self-giving, sacrifice. Second, we propose that Descartes’ texts acquire all their meaning if they are compared with the ethical notion of alterity in the philosophy of Emmanuel Levinas. -/- El problema de la alteridad puede plantearse en dos ámbitos: a) el de la alteridad absoluta, que Descartes desarrolla en la Tercera Meditación cuando el ego descubre su finitud como una negación y una aspiración de infinito; b) el de la alteridad relativa que me distingue de mi semejante. En primer lugar, arriesgamos una síntesis de los modos en que el alter ego pierde su alteridad al ser concebido como objeto de representación o de deseo. En segundo lugar, proponemos que Descartes piensa la alteridad en sentido puramente ético, como capacidad de bien y de mal. Nuestra tesis es, primero: el amor puro (sin deseo) es el amor paterno —el único dirigido al otro sí mismo por sí mismo y que abre la posibilidad de la donación de sí, el sacrificio; segundo: los textos de Descartes adquieren todo su sentido si se los compara con la noción ética de alteridad en la filosofía de Emmanuel Levinas. En 1983 Thomas Kuhn introdujo la distinción entre interpretación y traducción, con el propósito de fortalecer la tesis de la inconmensurabilidad y responder a objeciones formuladas por Donald Davidson y Hilary Putnam. A partir de este contexto de debate, este trabajo revisa la distinción kuhniana con el objetivo de explorar las conexiones que pueden establecerse entre las teorías rivales y las comunidades científicas que las defienden. Para ello examino el papel de la traducción, la interpretación y la comunicación en el (...) cambio teórico, con el propósito de ampliar la distinción de Kuhn y ahondar en algunas consecuencias no contempladas en su planteo original. Concluyo que la distinción entre estos planos lingüísticos resulta fundamental para comprender y evaluar el alcance de las divergencias suscitadas en casos de inconmensurabilidad. (shrink)

In the current context of widespread environmental collapse, ecological grief—the sense of loss that arises from experiencing environmental destruction—has become a burgeoning topic of inquiry across psychology, geography, and anthropology. The central challenge in the study of ecological grief is that its theoretical foundations remain underdeveloped. Recent discussions in philosophy of emotions elucidate that a central element in this theoretical challenge is determining what the object of ecological grief is. In turn, our understanding of the object of ecological grief goes (...) hand in hand with our understanding of the nature of ecological grief. This paper develops a phenomenological analysis of cross‐cultural subjective reports that identifies crucial themes in the experience of ecological grief. This phenomenological analysis reveals the object of ecological grief as the loss of the life possibilities that are sustained by dwelling. The resulting view is that ecological grief corresponds to a crisis in dwelling—a disturbance in the very way we inhabit our home environment. (shrink)

We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. The aim of this article is to contribute to the discussion about the so-called “empirical claim” and “empirical basis” of theory testing. First, the proposals of reconceptualization of the standard notions of partial potential model, intended application and empirical claim of a theory made by Balzer (1982, 1988, 1997a, 1997b, 2006, Balzer, Lauth & Zoubek 1993) and Gähde (1996, 2002, 2008) will be first discussed. Then, the distinction between “global” and “local empirical basis” will be introduced, linking it with that (...) of “global” and “local or particular empirical claim”. After that, following Balzer (1997a), along the lines of Suppes (1962), I will present a way in which what count as ‘data’ for a theory can be modeltheoretically represented and conceptualized. Finally, the proposed analysis will be exemplified with the case of classical genetics (reconstructed in Balzer & Lorenzano 2000, Lorenzano, 1995, 2000, 2002). (shrink)

A salient feature of de Broglie-Bohm quantum theory is that particles have determinate positions at all times and in all physical contexts. Hence, the trajectory of a particle is a well-defined concept. One then may expect that the closely related notion of inertial trajectory is also unproblematically defined. I show that this expectation is not met. I provide a framework that deploys six different ways in which dBB theory can be interpreted, and I state that only in the canonical interpretation (...) the concept of inertial trajectory is the customary one. However, in this interpretation the description of the dynamical interaction between the pilot-wave and the particles, which is crucial to distinguish inertial from non-inertial trajectories, is affected by serious difficulties, so other readings of the theory intend to avoid them. I show that in the alternative interpretations the concept at issue gets either drastically altered, or plainly undefined. I also spell out further conceptual difficulties that are associated to the redefinitions of inertial trajectories, or to the absence of the concept. (shrink)

Nowadays there is a growing interest in business ethics, both in academia and professionally. However, moral lapses continue to happen in business activities, leading academicians and professionals to rethink what is being done and reinventing new strategies to successfully manage ethics in business organisations. Thus, whereas efforts to promote ethics are basically oriented to using and developing explicit, written formal mechanisms, the literature suggests that other instruments are also useful and necessary to achieve this. Thus, studying the role of the (...) Human Resource Management (hereafter, HRM) in promoting ethics is an emerging research topic due to the heavy influence that HRM practices are thought to have on employees. This paper is aimed at developing a thorough analysis of HRM's role in promoting ethics, and specifically at focusing on one of its practices, training. As an illustrative example of the utility of this practice, an empirical study was conducted on a range of Spanish banking companies in which an impact was found on the employees' ethical behaviour when ethics training was being provided inside the organisation. Finally, the practical implications of these findings and directions for future research are presented. (shrink)

The solution John Buridan offers for the Paradox of the Liar has not been correctly placed within the framework of his philosophy of language. More precisely, there are two important points of the Buridanian philosophy of language that are crucial to the correct understanding of his solution to the Liar paradox that are either misrepresented or ignored in some important accounts of his theory. The first point is that the Aristotelian formula, ` propositio est vera quia qualitercumque significat in rebus (...) significatis ita est ', once amended, is a correct way to talk about the truth of a sentence. The second one is that he has a double indexing theory of truth: a sentence is true in a time about a time, and such times should be distinguished in the account of the truth-conditions of sentences. These two claims are connected in an important way: the Aristotelian formula indicates the time about which a sentence is true. Some interpreters of the Buridanian solution to the paradox, following the lead of Herzberger, have missed these points and have been led to postulate truth-values gaps, or surrogates of truth-value gaps, when there is nothing of this sort in his theory. I argue against this tradition of interpretation of Buridan and propose an interpretation of his solution to the Liar. (shrink)

The paper discusses certain discrepancies between The Copernican Revolution (1957) and The Structure of Scientific Revolutions (1962) by Thomas Kuhn. It shows that they present a different consideration of extra-scientific factors, that in the former have a higher explanatory weight. It states that in 1957 Kuhn applies a casuistical historiography, focused on the Copernican revolution, and in 1962 a structural historiography, focused on the invariable features of scientific revolutions. The paper concludes that the differences between these two works are significant (...) enough so as not to be considered an expression of the same view of science. (shrink)
